90 Day Fiance’s Michael Eloshway Loses Plea to Toss 10-Year Prison Sentence Over Illegal Videos (Exclusive)

90 Day Fiancé alum Michael Eloshway was shut down in his attempt to vacate his 10-year prison sentence over child pornography charges, Us Weekly can exclusively report.

According to court documents obtained by Us, on July 2, Eloshway, who is locked up at a low-security prison in Ohio, had his petition with the United States Court of Appeals denied.

The court was not persuaded by his argument that the lawyer who represented him at trial was “ineffective” for failing to ask the jury about their opinions on adult pornography. In addition, it didn’t buy his claim that the judge abused their discretion when imposing an “unreasonable sentence.”

In his appeal, Eloshway claimed his lawyer did not ask the right questions during the trial, which led to his conviction.

He also argued the judge should not have sentenced him to 121 months as someone “who lacked the intent to distribute, download or even [view the videos] and took measures to prevent its distribution once he discovered that its presence would inadvertently appear on his computer.”

As Us previously reported, Eloshway was found guilty of possessing and distributing illegal videos in October 2024. He was ordered to serve a decade in prison, pay $10,000 in fines and another $5,000 to two victims that were in videos found on his computer.

Once released, Eloshway will have to serve 10 years on probation, register as a sex offender and submit to recommended treatment. He will not be allowed contact with any children, including his own, unless his probation officer signs off.

“You must not have direct contact with any child you know or reasonably should know to be under the age of 18, including your own children, without the permission of the probation officer,” the sentence read. His probation officer will also be allowed to do random searches of his computers.

In court, prosecutors described videos found on Eloshway’s device as horrifying. The former TLC star’s lawyer said his client was only intending to view adult pornography.

The government scoffed at Eloshway’s claims and told the court the reality star was “more than just a casual observer who happened to download [the illegal videos] when seeking legal pornography.”

Prior to his sentencing, Eloshway’s wife, Aziza Eloshway, wrote a letter to the judge.

“I am his wife of 11 years. I have known him for over 12 years and can assure you that this conviction is not a reflection of his true character,” Aziza, wrote. “Mike is a loving father, a caring husband, a loyal friend and, overall, a good and kind person.”

Aziza added, “We have a five-year-old daughter together. Her name is Olivia and Mike is a very involved parent. She is very attached to Mike as he is a very loving and caring dad.”

Eloshway’s wife told the judge the family was “torn apart” and that her husband had been “tortured by his feelings of guilt and regret for the irresponsible mistake that he’s made.” She asked the court to consider her letter when sentencing Eloshway.

His mother also wrote a letter.

Prosecutors asked the court to sentence Eloshwayy to 20 years in prison.

Michael and Aziza appeared in season one of 90 Day Fiance, which premiered in 2014.
