RHOA’s Kandi Burruss Demands Judge Seal Divorce Records as Custody Battle With Ex Todd Ignites (Exclusive)

The Real Housewives of Atlanta alum Kandi Burruss made moves in court to keep her divorce out of the public eye, days after her estranged husband, Todd Tucker, demanded primary custody of their kids, Us Weekly can exclusively report.

On Monday, December 2, Burruss, 49, explained to the court that she and Tucker, 52, are “public figures working in the entertainment, television and film industries.”

Burruss said it was in the best interest of the parties’ two kids, Ace, born in 2016, and Blaze, born in 2019, that all financial information, along with information about the kids, be kept confidential.

The musician and reality star also asked that all filings, testimony and other evidence be sealed.

In her filing, Burruss’ lawyer said, “that it is in the best interests of the minor children that the proceedings and all aspects within be sealed to prevent disclosures on social media, internet, and media at large while the matter is pending before the Court and thereafter compromising the integrity of the overall proceedings.”

Tucker has not responded to Burruss’ request.

As Us first reported, on November 26, Tucker filed court docs in the exes’ ongoing divorce demanding primary custody of the two children. (Burruss filed for divorce on November 21 and initially asked for joint custody, but switched her request to primary custody after Tucker asked for sole custody.)

As part of his request, Tucker told the court that Burruss was quite busy with work and “will continue to require her to be away from the children for at least the next several months.”

In his filing, Tucker’s lawyer wrote, “The parties have been working cooperatively in an effort to resolve all issues, and [Tucker] remains committed to continuing those discussions in good faith.”

Tucker’s lawyer said, “in the hopefully unlikely event” that his client and Burruss could not reach a custody agreement, Tucker will be seeking primary custody and joint legal custody. In his filing, Tucker made it clear that he believed Burruss was an amazing mother.

“[Tucker] wishes to make clear that he recognizes [Burruss] as a loving and capable parent and remains sincerely hopeful that prior and continued discussions between the parties will bring full resolution of all matters,” Tucker’s attorney noted in court docs.

As Us first reported, Burruss and Tucker are also going back and forth about the prenuptial agreement they signed before their wedding on April 4, 2014. Tucker claimed he had a lawyer, who had been in contact with Burruss’ lawyer about the prenup, but was presented a final draft right before the wedding without his lawyer present. He suggested the prenup may not be enforceable.

Tucker’s lawyers said the prenup “was presented to [Tucker], without [Tucker] having counsel, even though [Burruss’] then counsel had communicated previously with [Tucker’s team] regarding a potential prenuptial agreement.”

“[Burruss’] counsel presented the final agreement to [Tucker] for signature immediately before the wedding ceremony, without any notice to or consultation with [Tucker’s team], who had been significantly engaged in the negotiation process,” Tucker’s divorce lawyer alleged.

The attorney added, “These circumstances raise substantial questions concerning the enforceability of said document.”

Burruss scoffed at Tucker’s views on the prenup. In her amended petition, where she listed the date of separation as July 15, Burruss said Tucker had a lawyer before the wedding in regard to the prenup.
In her filing, Burruss also pointed out that Bravo filmed their wedding preparations, including the prenup negotiations.

Burruss noted that Tucker was filmed “audibly” announcing that he was “good to sign” the prenup after speaking to his lawyer.
