Mary Cosby’s son, Robert Cosby Jr., was charged with domestic violence and had a warrant out for his arrest leading up to his tragic death.
The 23-year-old was charged with felony aggravated assault and felony assault on February 5, TMZ reported Thursday.
Officers told the outlet that an alleged victim reported Robert on Nov. 23, accusing him of becoming angry after she threw his drugs in the toilet in May.
While the alleged victim’s name wasn’t revealed, the initials linked to the case were A.S., and they referred to Robert as “husband.”
Robert, who was candid about his drug abuse issues, was married to his estranged wife, Alexiana Smokoff, when he died on Monday from an apparent overdose.
Per the outlet, the victim alleged that he “beat her about the face and head, and kicked her in the stomach.”
A.S. claimed she was choked for several seconds and couldn’t breathe.
The victim showed officers her injuries from the alleged encounter, showing a visibly “red and swollen” eye, an eyebrow lump and a mark on her neck.
According to TMZ, Robert was due to face a harsher sentence due to former domestic violence crimes.
Additionally, Mary was listed as a witness on the police report because she handed over evidence.
The Salt Lake City Police Department wasn’t immediately available to Page Six for comment.
The “Real Housewives of Salt Lake City” star’s son was found dead on Feb. 23 after officers “responded to an overdose call that turned into a death investigation.”
Mary addressed Robert’s death shortly after the news broke on Wednesday, writing via Instagram that she knows “he is finally at peace.”
“Our beloved son Robert Jr. has been called home to the Lord,” she said. “Though our hearts ache, we take comfort in God’s promise and in knowing he is finally at peace. We are grateful for your prayers and trust in the Lord to carry us through this time of sorrow.”
At the time of his death, Robert was going through divorce proceedings with Smokoff, who pulled the plug on their relationship after three years of marriage in November.
Additionally, he was arrested in November for allegedly violating Alexiana’s restraining order.
Robert pleaded guilty to the charges against him and was released from jail earlier this month.
In a statement to People, his lawyer stated that he “express[ed] deep regret regarding his prior actions and acknowledg[ed] that his past behavior demonstrates poor judgment.”
