Jay Cutler hit with lawsuit over DUI crash after getting jail time

The driver Jay Cutler hit in his DUI incident last year, for which the former NFL star was sentenced to jail time, is now suing him.
The driver, who’s been identified as Perry Lee, filed a lawsuit on Sept. 2. He’s seeking unspecified compensation for unexpected medical bills, “physical pain and mental suffering,” as well as “loss of enjoyment of life as a direct and proximate result of the collision,” according to the documents obtained by People.
Lee also claims he “suffered lost wages, loss of earning capacity, or other out-of-pocket expenses, or some combination thereof, as a direct and proximate result of the collision” that occurred in Franklin, Tenn., on Oct. 17, 2024.
“Our client is a veteran who was injured in a car crash due to the alleged negligence of another driver,” Pierce and Morgan & Morgan founder John Morgan, whose company is representing Lee, said in a statement to the outlet.
“His injuries from the crash cause him daily pain and have eroded his quality of life,” the statement continued. “We are seeking justice for him so he can get the care he needs and try to move forward with his life.”
Lee’s attorney, Sydney Pierce, also stated in the documents that Cutler was intoxicated at the time of the crash.
“Cutler failed to use reasonable and due care in the operation of the vehicle he was driving so as to avoid injury to other persons using the roadway, including [Lee],” Pierce wrote.
Cutler’s rep didn’t immediately respond to Page Six’s request for comment.
Last month, the former Chicago Bears quarterback was sentenced to four days behind bars after striking a plea deal in his DUI and gun possession case.
Cutler, 42, pleaded guilty to one count of misdemeanor DUI. Prosecutors dismissed his weapon possession charge upon forfeiture of the weapon.
Aside from his jail time, he was also fined $350 and will be required to be on one year of supervised probation and submit to regular and random drug tests.
Additionally, his license was revoked.
Kristin Cavallari’s ex-husband was arrested last October for DUI, gun possession, failure to exercise due care and violation of implied consent law.
Cutler rear-ended another car and allegedly attempted to flee the scene before police arrived, the Franklin Police Department told Page Six at the time. Per the police report, he offered to pay the driver $2,000 if they didn’t call police.
When officers arrived, they claimed he was visibly intoxicated. Upon search of Cutler’s white Ram truck, officers found two firearms in the vehicle, including a loaded pistol.
While Cutler has never commented on the incident, Cavallari — who shares sons Camden, 13, Jaxon, 11, and daughter Saylor, 9, with him — addressed his arrest on her podcast, “Let’s Be Honest.”
“I do, of course, wish Jay nothing but the best, and I do hope that he gets the help that he needs, but that’s the only thing I will be saying about it publicly,” she said.
