KJ Biermann, 15, makes legal move in sodomy, sexual battery case to avoid adult prison sentence
Kim Zolciak’s 15-year-old son, Kroy “KJ” Biermann Jr., is asking to be transferred to juvenile court after being indicted on seven felony charges in his sexual assault case, Page Six can exclusively reveal.
The teen’s legal team filed a motion to “transfer to juvenile court and for confidentiality proceedings” on Tuesday, according to the Fulton County Court.
The move signals that KJ’s attorneys are asking the Superior Court to transfer his case to Georgia’s juvenile justice system, where he would no longer be prosecuted as an adult and could face less severe consequences if convicted.
KJ’s lawyer, Jason Sheffield, told Page Six Tuesday that they expect to “enter a not guilty plea to all charges” at the arraignment hearing on Oct. 14, and that they planned on filing the motion so he could be “tried as a juvenile.”
“It is difficult to comprehend that a 14- or 15-year-old child can be held in detention for a month or longer simply waiting for a bond hearing,” Sheffield told Page Six in a statement. “But that detention is a direct consequence of the detective’s decision to arrest him on charges of this magnitude.”
Last week, KJ was indicted by a Georgia grand jury on seven felony charges: aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of sexual battery against a child under 16 and false imprisonment.
He was arrested for aggravated sodomy and aggravated sexual battery in Alpharetta, Georgia, on Aug. 19, after a female classmate accused him of assaulting her in a gym changing area on April 23.
According to court docs, the alleged victim claimed to investigators that KJ allegedly forced himself on her after she told him no while they were in a co-ed sauna.
KJ allegedly made “multiple” attempts to have “sexual intercourse with her by trying to pull down her pants,” the court documents stated. She also accused him of forcing oral sex and digitally penetrating her vagina.
The young woman finally managed to get away from him but did not tell anyone about the alleged assault until the next day — after which she underwent an examination at the local hospital. A police report states that no evidence of male DNA was found in her mouth or vagina during the April 24 examination.
KJ is being held without bond at Atlanta’s Metro Regional Youth Detention Center.
His bond hearing, initially scheduled for Tuesday but cancelled, has been rescheduled for Sept. 11.
