Details From Kyle Busch’s Will Revealed, Racer’s Family Will Not File Wrongful Death Suit

Details from Kyle Busch‘s last will and testament have been revealed.

According to documents obtained by Us Weekly on Tuesday, June 16, the racer left his tangible personal property to his wife and now widow, Samantha Busch. Samantha will receive all of Kyle’s belongings, including his automobiles, furniture, household furnishings, clothing, jewelry, collectibles and personal effects.

The will also stated that lawyer Clifton Homesley is to be named the executor of Kyle’s estate. If Homesley “fails or ceases to act” as Kyle’s executor, John S. Fuller will be named as a potential replacement.

Kyle asked for his “debts, health care expenses, funeral expenses and the administration expenses of my estate” to be paid out of his residuary estate, which is handled by the executor. The executor is also in charge of managing Kyle’s investments, sale or other disposition of property, management of property, business interests, borrowing or lending money and more.

Additional paperwork also stated that Kyle’s family will not be filing a wrongful death lawsuit despite a prominent sports medicine doctor previously claiming the athlete’s death was preventable.

Last month, news broke that Kyle died at age 41. One day before his death, the racecar driver was hospitalized after he was found unresponsive in a racing simulator in North Carolina. According to his death certificate obtained by Us, Kyle had pneumonia for “days or weeks” before his death, leading to sepsis, a potentially fatal blood infection that can cause multi-organ failure.

Kyle is survived by his wife of 15 years, Samantha, and their two children: son Brexton, 11, and daughter Lennix, 4.

Samantha, 40, broke her silence in the wake of her husband’s death earlier this month, thanking fans for their support and well wishes amid the family’s tragedy.

“As a family, we wanted to take a moment to say thank you,” she wrote via Instagram on June 5. “The prayers, messages, flowers, meals, hugs, and countless acts of kindness have carried us through the most heartbreaking days of our lives. While our hearts are absolutely shattered, we have felt God’s presence and arms wrapped tightly around us through each and every one of you.”

Samantha added that the “love” she and her family felt gave them “comfort in the middle of so much pain.”

“Knowing the impact Kyle had on others and seeing how they are honoring him through each unique act of generosity is a true testament to how special Kyle is to so many people,” she continued. “There are moments when the weight of this loss feels impossible to carry, yet time and time again God, through you all, has shown us we are not alone.”
